Lance Shapiro is an associate in the Intellectual Property Practice Group in the firm's New York office.

Areas of Practice

Lance is an experienced patent litigator and licensing advisor in the intellectual property litigation practice, with particular expertise with standard essential patents (SEPs) and related Fair, Reasonable, and Non-Discriminatory (FRAND) licensing matters and agreements. His litigation practice includes a diverse array of technological domains, encompassing cellular telecommunications standards (4G/LTE, 5G), video coding standards (H.264, H.265, AV1), networking standards (G.709), consumer electronics, semiconductors, computer-based technologies, and display technologies (LCD).

Lance has litigated in virtually every major patent jurisdiction, including the District of Delaware, the Eastern and Western Districts of Texas, the Northern District of California, the International Trade Commission (ITC), the Patent Trial and Appeal Board (PTAB), and the U.S. Court of Appeals for the Federal Circuit. His litigation proficiency covers all facets of litigation, including conducting pre-suit analyses; identifying invalidity, infringement and claim construction positions; leading discovery; and participating in trial and appeal proceedings. Lance also maintains an active pro bono practice in state and federal courts and before federal agencies.

During law school, Lance completed two internships with the Honorable Kathleen M. O’Malley of the U.S. Court of Appeals for the Federal Circuit. Prior to law school, Lance worked as an engineering consultant for Booz Allen Hamilton, where he developed statistical analytics for a predictive expenditure management software system. He also worked as an engineering intern for three summers at Northrop Grumman during his undergraduate studies.

Lance earned a degree in systems engineering with high distinction from the University of Virginia, where he was a member of the prestigious Rodman Scholars Honors Program. Lance also studied abroad for two summers at the University of Vienna, focusing on German language and European legal and economic studies.

Tex.): Defending leading technology company in litigations involving video coding (AV1), cellular and wireless communications (5G and Wi-Fi 6), and content distribution, originally filed in the Eastern District of Texas, transferred to the Northern District of Texas, and re-filed in the Western District of Texas.
  • A Leading Global Consumer Electronics and Technology Company (W.D. Tex.): Representing leading worldwide technology company in 5G cellular communications patent dispute.
  • A Leading Display Device Manufacturer (E.D. Tex.): Defending leading LCD display manufacturer in two suits covering ten patents directed to LCDs, methods of manufacturing LCDs, and related components.
  • A Tier 1 International Telecommunications Company (S.D.N.Y.): Representing multinational telecommunications equipment company in patent license agreement dispute.
  • A Worldwide Database and Software Company (N.D. Cal., PTAB): representing European-based software corporation in multi-patent suit relating to databases, user interfaces, and website creation technology.
  • A Korean-Based Multinational Electronics Company (D. Colo., PTAB): Defending multinational technology company in suit alleging infringement of eleven patents directed to image sensors in smartphones and tablets.
  • A Global Computer Manufacturer (ITC, D. Del): Represented global PC manufacturer involving H.264/AVC, H.265/HEVC, and AV1 video coding standard essential patents and related FRAND issues at two ITC hearings.
  • A Leading Korean Display Device Manufacturer (E.D. Tex.): Defended manufacturer in twelve-patent litigation involving LCD manufacturing and structures.

  • A Worldwide TV and Technology Manufacturer (E.D. Tex., PTAB): Represented TV manufacturer in a five-patent lawsuit related to smart TV technology and interfaces, leading to a highly favorable settlement before trial.
  • An International Patent Portfolio Holding Company (D. Del., PTAB): Represented portfolio holding company in a patent infringement suit involving eight patents related to semiconductor technology and in related IPRs, resulting in a favorable settlement.
  • An International Patent Portfolio Holding Company (E.D. Tex., PTAB): Asserted portfolio of patents essential to the 4G/LTE and 5G telecommunications standards against worldwide cellular infrastructure manufacturers.
  • A Tier 1 International Telecommunications Company (E.D. Tex., D. Del.): Successfully defended major multinational telecommunications company in an action alleging infringement of patents directed to various networking, 4G/LTE, and Power-Over-Ethernet technologies, resulting in highly-favorable settlement.
  • A Leading Korean Electronics Manufacturer (E.D. Tex.): Defended electronics manufacturer and obtained favorable early settlement in a five-patent suit concerning electronic payments.
  • A Leading Korean Electronics Manufacturer (W.D. Tex., PTAB): Defended electronics manufacturer in suit involving memory devices and variable charge circuits.
  • A Korean-Based Multinational Electronics Company (E.D. Tex., PTAB): Defended multinational electronics company in patent infringement involving six patents related to LED displays.
  • A Major International Automotive Manufacturer (D. Del., PTAB): Defended international automotive manufacturer in patent infringement litigation relating to adaptive cruise control technology.
  • A Startup Software and Security Company (D. Mass, E.D. Va., C.D. Cal., Fed. Cir.): Represented startup in a series of district court actions and related appeal directed to out-of-band authentication techniques and systems.
  • A Korean-Based Multinational Electronics Company (E.D. Tex.): Defended major multinational electronics company in a patent infringement suit involving authentication, which settled after our client filed a motion to dismiss on § 101 grounds.
  • Global Computer Gaming Companies (PTAB, Fed. Cir.): Represented three global computer gaming companies in multiple petitions for inter partes review challenging patents related to broadcasting information over computer networks and appeals to the Federal Circuit.
  • A Korean-Based Multinational Electronics Company (E.D. Tex.): Defended major electronics manufacturer in district court regarding image sensors and imaging software.
  • A NY-Based Artist (S.D.N.Y.): Defended NY-based artist against copyright infringement, trademark infringement, and unfair competition (Lanham Act) claims, resulting in favorable summary judgment on all pending claims against client and leading to favorable settlement on client’s counterclaims.
