The landscape for PFAS regulations and related litigation is rapidly evolving and creating compliance and operational challenges for businesses. More than 130,000 companies are now on the clock to collect and report a significant amount of data concerning PFAS to the EPA in 2026, unless Congress amends the Toxic Substances Control Act. In addition, various states are imposing reporting requirements and sale prohibitions on PFAS-containing consumer products such as food packaging, cookware, children’s products, clothing, carpets and rugs, upholstered furniture, fabric treatments, cosmetics, feminine hygiene products, and cleaning products.
