Susan Warshaw Ebner Publishes Tips for Bidding on Government Contracts
Partner Susan Warshaw Ebner’s recent article published in the National Defense Industrial Association (NDIA)'s National Defense explains the Department of Defense Cybersecurity Maturity Model Certification (CMMC) program and provides some helpful tips for contractors when bidding on contracts. She and her co-author, Rolando Sanchez, are co-chairs of the Cyber Legal Policy Committee of the NDIA Cybersecurity Division. They discuss the rollout of the CMMC program, and provides an overview of the NDIA's four-part tabletop series that is designed to answer contractor questions and cover best practices for CMMC compliance.
"Contractors may have multiple domains or systems. One best practice for CMMC compliance, if a contractor can do it, is to make sure their whole system is secured as there is going to be a value-add there," said Susan. She also recommended being highly diligent in preparing the required self-assessment to avoid a potential False Claims Act violation.
In her practice, Susan represents businesses and nonprofits on a broad spectrum of government contract and compliance matters, including bid protests, cyber security and supply chain risk, compliance program development and training, audits, investigations, claims, and dispute resolution. She also counsels clients on federal research and development-related matters, including small business innovation research (SBIR and STTR), other transactions, technology investment agreements, cooperative agreements and grants. She also serves as the Section Chair of the American Bar Association Public Contract Law Section.
