Overview
Austin focuses his practice on helping clients with a broad range of litigation matters in both federal and state court and in arbitration. His work includes business torts, complex breach of contract claims, real estate disputes, and others.
Austin is also experienced in intellectual property matters, including brand protection and intellectual property infringement disputes. Austin helps clients protect and defend their brands through trademark and patent enforcement, including in proceedings in courts and before government examiners, as well as through pre-litigation efforts such as cease and desist letters.
Before joining the firm as an associate, Austin worked at Stinson as a summer associate, where he assisted in both litigation and corporate matters.
Experience
Represented a lender in a dispute over construction equipment used to secure the debtor’s loan.
Part of a case team that obtained dismissal of claims for tortious interference brought against a company that financed a clean energy development.
Obtained dismissal of Telephone Consumer Protection Act (TCPA) class action after moving to compel arbitration of lead plaintiff’s claims.
Defended breach of fiduciary duty claims brought against financial advisor.
Represented real estate investor, bringing claims against broker that stole funds to be used for payment of closing costs.
Successfully brought Trademark Trial and Appeal Board (TTAB) expungement and cancellation proceedings to cancel trademarks that had been cited against his client's trademark applications.
Represented business owner who faced allegations of fraud following sale of business, asserting claims related to buyer’s failure to pay.
Initiated numerous successful Uniform Dispute Resolution Proceedings (UDRP), enforcing clients' trademark rights in cyberspace.
