Overview

Ben leverages his sage understanding of real estate law, as well as his extensive experience in multifamily housing, commercial real estate and leasing, and public finance to support clients in a variety of ways.

Ben brings substantial experience to data center property development, particularly in title, survey and other due diligence review processes. He offers a practical understanding and application of unique considerations necessary for successful data center development, specifically the availability for utility connectivity.

He also assists clients in the hospitality industry, including bars, restaurants and liquor stores, ensuring they remain compliant with liquor licensing regulations. Additionally, Ben works with hotel and motel investors, as well as franchised hotels and motels, to address their business and legal needs. He also assists clients with complex title matters, ground lease agreements and utility easements for solar development.

Ben maintains an active pro bono practice, representing the Marlborough Community Coalition in actions under the Missouri Abandon Housing Act. This work helps rehab dilapidated housing in Kansas City’s urban core and provides mixed-income homeownership opportunities.

Multifamily

Assisted a real estate investment trust in disposition of an $800 million multifamily portfolio throughout the Southeast and Midwest regions.

Assisted in acquisition and disposition of various multifamily properties, including assumption of U.S. Department of Housing and Urban Development loans and loan defeasances.

Commercial

Hospitality

Assisted in representation of hospitality investors in acquisition and disposition of nationally- and regionally-branded and franchised hotels and motels.

Assisted in representation of restaurant and entertainment operators obtaining and renewing the State of Missouri and local jurisdiction liquor licensures.

Solar

Assists in representation of wind and solar renewable energy developers in negotiating lease and site control documents, drafting and negotiating utility access easement agreements, drafting and negotiating crossing agreements with utility providers, negotiating owners' and lenders' title insurance policies with national commercial underwriters, and reviewing and clearing title and survey matters, including mineral rights issues.

Leasing

Assisted in representation of both landlords and tenants in commercial leases for various property types, including shopping centers, bars and restaurants, and office spaces.

Public Finance 

Assisted in representation of formation and administration of Missouri Community Improvement Districts and Transportation Development Districts.
