Businesses, national banks and loan servicers depend on Brad for his firm grasp of real estate law litigation, lending practices, employment, bankruptcy and creditors' rights issues. He's their go-to lawyer when facing commercial litigation.
Experience
Brad has disposed of hundreds of matters from inception over the years involving leasing, eminent domain, taxation, development, mechanics liens, lien priority, reformation, foreclosure, eviction and various adversary matters.
His appellate experience includes arguing the seminal Kansas Supreme Court case that established how lenders handle second mortgages in default, Fidelity Bank v. King.
Brad served as both trial and appellate counsel to Kansas City area condominium owners and their lenders in a dispute with a subdivision developer over the common area allocated to their property in Fastnacht v. Ge, 488 S.W.3d 178 (Mo.App.W.D., 2016).
Brad has resolved multiple state and federal court claims arising pursuant to state usury laws and represented lenders in Truth Lending (TILA) Residential Settlement Procedures Act (RESPA) and Fair Debt Collections Practices Act (FDCPA) litigation.
Sharing his knowledge with others, Brad is a regular presenter at real estate and litigation seminars in the Midwest.
