Overview
With more than 20 years of experience in data governance, privacy, systems cybersecurity, software and AI development and deployment, intellectual property, litigation, and B2B and B2C transactional risks, Jenifer skillfully aligns business goals with long-term enterprise sustainability, resilience, and profitability. Her background as a chemist and in-house counsel enhances her ability to translate legal standards into easy-to-understand technical and operational processes that clients can implement intelligently, with an eye towards the future, rather than trepidations about the past.
Her practice focuses on data governance and data security issues related to technology-driven enterprise initiatives, product development, and transactions, as well as identifying risks related to data processing, cybersecurity, and AI development in an effort avoid federal and state regulatory inquiries, but also limit risks from data security breach and data-centered class-action litigation. She counsels clients across a variety of sectors, including cybersecurity, SaaS, e-commerce, private equity, OEM, and automotive as well as several technology industries including pharmaceutical, health, financial, education, and advertising.
She is highly-skilled in developing and implementing practical and sustainable corporate governance initiatives, C-suite and board level guidance, as well as strategic compliance involving global privacy laws.
Jenifer has extensive experience handling international transfer requirements, cybersecurity risk management and cyber-insurance risks, SaaS development strategy, corporate data governance, and the impact of dark patterns and customer user experience in e-commerce. She is also adept at preparing for and responding to concerns with cybersecurity incidents, privacy issues in clinical trials and health care, children's privacy, government agency enforcement, artificial intelligence development and data integrity issues, wiretapping and privacy claims, programmatic marketing, privacy investigations, and workplace privacy compliance.
In addition, Jenifer frequently counsels commercial litigation cases, including complex contract and licensing disputes, patent litigation, business torts and regulatory investigations defense.
Experience
Jenifer has extensive experience advising clients regarding compliance obligations with regional, national and international privacy laws, including GDPR, CCPA/CPRA, COPPA, FERPA, GLBA, HIPAA, FDA, CAN-SPAM, CASL, PIPEDA, APPI, 23 NYCRR 500, Safeguards Rule, SEC, CFPB, DOJ Bulk Data Transfer, and FTC data processing oversight, state data privacy, breach, employment and education laws, and deployment of cybersecurity frameworks including NIST, ISO, SANS, and others.
She assists clients in establishing applicable security frameworks and programs, creating privacy-by-design protocols for product development, conducting cyber and data governance due diligence during transactions, guiding portfolio company data governance and AI deployment initiatives, and negotiating vendor and licensing agreements to ensure data security and statutory compliance.
