Overview
Keegan focuses his practice on business and commercial litigation in both state and federal courts. His practice focuses on business torts, insurance disputes and real property disputes, and he has significant experience in property ownership and real estate secured lending, shareholder disputes, health insurance and ERISA claims, commercial disputes, product liability and toxic torts, eminent domain, disputes involving life insurance proceeds, and bankruptcy avoidance actions. He has also appeared before planning and zoning commissions and county boards throughout Missouri and Illinois to object to the construction of competing cell towers. Keegan's varied experience provides him with an in-depth understanding of the law across multiple subject areas and industries, enabling him to effectively and efficiently counsel clients with practical recommendations and creative solutions.
Experience
Business Torts
Second-chaired an eight-day arbitration evidentiary hearing and defeated claims asserted by 50/50 shareholder alleging breach of fiduciary duty and improper use of company funds by client shareholder.
Assisted in drafting winning appellate brief affirming judgment against controlling members of LLC for breach of fiduciary duty and misuse of company funds, and divesting controlling members of ownership interests in favor of clients.
Insurance Disputes
Successfully resolved claim relating to payment of accidental death life insurance benefits prior to commencement of litigation.
Successfully resolved multiple ERISA claims in mediation.
Successfully negotiated dismissal of contract claims brought by employer against health insurance company after moving for summary judgment on behalf of health insurance company.
Drafted winning dispositive motion and delivered oral argument to defeat claim for breach of life insurance contract seeking payment of insurance proceeds.
Real Property Disputes
Drafted multiple winning dispositive motions in real property disputes, including defeat of prior-recorded mortgage lien in favor of insured lender, defeat of claims seeking to set aside property deeds in favor of insured property owner, and defeat of claims seeking to set aside insured lender’s mortgage interest based on third-party fraud allegations.
Drafted winning appellate brief confirming validity of foreclosure sale and curing title despite third-party fraud allegations.
Successfully protected client's real property from bankruptcy trustee seeking title based on typographical error in vesting deeds.
