Overview
An accomplished trial attorney, Keith enjoys a diverse business litigation practice in the areas of intellectual property, estates and trusts litigation, contract disputes, environmental law, professional negligence, construction-related disputes, banking litigation and regulatory matters.
Keith has extensive courtroom experience, having successfully tried cases to verdict in both state and federal courts across the country, as well as litigating numerous arbitrations and administrative proceedings. In addition to providing experienced advocacy in court, Keith utilizes that experience to counsel clients in negotiating contracts and taking other prudent actions to stay out of court.
Experience
Keith successfully represented the beneficiary of a $75 million charitable trust in claims for breach of fiduciary duty and reformation of the trust.
Successfully prosecuted and defended Covid-19-related force majeure delay and damages claims.
He successfully defended an architecture firm against multimillion dollar building collapse design defect claims.
Keith obtained an $8 million judgment for an industrial construction contractor in a wind farm development dispute.
He argued and won a groundbreaking decision in the Minnesota Supreme Court invalidating the Ponzi scheme presumption and clarifying Minnesota fraudulent conveyance law.
Prior to joining the firm, Keith was an assistant attorney general with the State of Minnesota, representing the Minnesota Pollution Control Agency.
