Terri has a wealth of experience in debtor-creditor matters and has held various roles within the bankruptcy and banking sectors, including lender, creditor's attorney, debtor's attorney, trustee and trustee's attorney.
Terri has a demonstrated history of success in adversary proceedings. She has secured favorable judgments for clients at both the trial and appellate levels and excels in both representing and defending against litigation actions.
She represents a wide range of clients in complex bankruptcy litigation matters, including preference and fraudulent transfer claims, asset sales, discharge disputes, workouts, settlements for distressed loans and secured transactions. Terri also has significant experience representing debtors across Chapter 7, 11 and 13 bankruptcy cases.
Terri frequently speaks on topics related to bankruptcy, banking and equipment leasing finance.
Experience
Represented a chapter 7 trustee in various bankruptcy litigation matters, including preference and fraudulent transfer claims, sales of assets free and clear of liens, objections to claimed exemptions, objections to proof of claims and denial of discharge.
Litigated a contested motion for relief from an automatic stay in favor of creditor involving residential real estate.
Represented a national bank in connection with various out-of-court workouts and settlements and other bankruptcy matters relating to a commercial loan portfolio.
Represented defendants in bankruptcy litigation involving preference fraudulent transfer claims.
Obtained judgment in favor of defendant in adversary proceeding for willful and malicious injury at trial and subsequent appeal to the Eighth Circuit Bankruptcy Appellate Panel.
Obtained judgment at trial in favor of plaintiff, successfully arguing that his student loans are dischargeable debt under 11 U.S.C. section 523(a)(8) based on undue hardship.
