On March 31, 2011, the Centers for Medicare and Medicaid Services (“CMS”) released a notice of public rulemaking for the long awaited proposed regulations to implement the Medicare Shared Savings Program for Accountable Care Organizations (“ACO”). The proposed ACO regulations outline criteria for ACO eligibility, governance and management requirements for participation, and conditions for shared savings distributions.
