At the end of 2022, the Office for Civil Rights (OCR) at the U.S. Department of Health and Human Services (HHS) issued a bulletin discussing the use of online tracking technologies by entities subject to HIPAA regulations. This bulletin is a significant development for health care providers, as it broadens the scope of protected health information and raises crucial questions about the collection and usage of website data. Under the new bulletin, information such as IP addresses can be treated the same as traditional HIPAA protected health information, like clinical notes, X-ray results, and prescriptions.
