Miller Quoted in Columbus Dispatch Story Titled “Apartment Complex Accuses Delaware of Housing Discrimination”

Joe Miller, a partner in the Vorys Columbus office and the chair of the firm’s litigation group, was quoted in a Columbus Dispatch story titled “Apartment Complex Accuses Delaware of Housing Discrimination.”  According to the story, a lawsuit filed by Seattle House LLC accuses the city of Delaware of violating federal fair housing laws by inflating sewer and water fees to keep minorities out of the city.

The story states:

“To prevail, such a suit does not have to prove intent to discriminate, said Joseph Miller, the attorney for Vorys, Sater, Seymour and Pease who filed the suit on behalf of Seattle House.

‘Even if an ordinance is facially neutral, if it has a disparate impact upon minorities, it is discriminatory,’ Miller said. ‘We think this is a clear violation of the Fair Housing Act.’

The suit is the biggest weapon yet in a long-simmering war between developers and municipalities over fees and building restrictions that developers say have pushed new homes and apartments out of reach for many central Ohioans.”
