Miller Quoted in Dayton Daily News Story Titled "Owners of Former Store Sue Xenia; Lawsuit Alleges City Damaged Wall During Next-Door Demolition"
Joe Miller, a partner in the Vorys Columbus office, was quoted in a Dayton Daily News story titled “Owners of Former Store Sue Xenia; Lawsuit Alleges City Damaged Wall During Next-Door Demolition.” The story was about a lawsuit filed by Miller on behalf of the owners of a building in downtown Xenia.
The story states:
“Blue Rock Investments and Boymel Family have filed a lawsuit against the city of Xenia in connection to the demolition of the old Kmart building, which the suit alleges led to damage to the adjacent former Fulmer's store.
Blue Rock is seeking unspecified compensation, saying Xenia damaged walls of this building.
The owners of the former Fulmer's grocery store in Xenia have filed suit against the city, claiming the demolition of the old Kmart building damaged what is now an exterior wall of the Fulmer's building.”
The story also states:
“Miller said his clients are still calculating the costs for repairs to restore the building, but it's expected to cost several hundred thousands of dollars.
‘Since they continue to deny any liability and are using the city's powers against us, we had to file this lawsuit,’ Miller said.”
