Miller Quoted in Olentangy Valley News Story titled “City Mulls New Plan; Will Voters Have Say?”
Joe Miller, a partner in the Columbus office, was quoted in an Olentangy Valley News story regarding about a pending Powell City Council vote on the rezoning of a parcel of land. According to the story, Powell residents voted in 2015 to block a zoning change needed for the development of 47 standalone condominium units at the site. The new proposal, pending before council, calls for the construction of 48 single-family houses on the site.
The story states:
“According to the charter, ‘Ordinances rejected or repealed by an electoral vote shall not be re-enacted, in whole or in part, except by an electoral vote.’
Joseph R. Miller, Pivar's attorney, said another ballot issue would not be necessary because council would not be re-enacting legislation rejected by voters. He said the new plan is considerably different compared with the old proposal and noted the developer has requested different zoning.”
