Miller Quoted in This Week: Worthington Story Titled “Lifestyle Communities Attorney Raises Legal Question About Recent Actions by Worthington City Council”

Joe Miller, a partner in the Vorys Columbus office, was quoted in a This Week: Worthington story about Lifestyle Communities’ plans to redevelop a former United Methodist Children’s Home (UMCH) site in Worthington. According to the story, Lifestyle Communities presented its first proposal to redevelop the site in 2015. A second proposal had entered a holding pattern late in 2020. The latest plan has also be stalled because of actions related to the City of Worthington.

According to the story, the city council recently passed a comprehensive plan amendment which sets new standards for future redevelopment applications at the former UMCH site. The council also considered but did not pass a one-year moratorium on development applications for the site

The story states:

“During the public comment period, Vorys attorney Joe Miller alleged that the city’s actions regarding the moratorium and amendment were ‘illegal’ and ‘unenforceable.’

‘The proposed moratorium, and the amendment to the city’s comprehensive plan, approved without any notice whatsoever to my client, are both illegal – both of them – and unenforceable for numerous reasons,’ Miller said.

Worthington officials are looking into the question of legality, according to city spokesperson Anne Brown.”
