Vorys Client Wins Summary Judgment in an Air Permit Appeal before Ohio Environmental Review Appeals Commission
The Ohio Environmental Review Appeals Commission (ERAC) recently granted summary judgment in favor of our client, Harrison Power, LLC, in an appeal filed by the Ohio Valley Jobs Alliance (OVJA). OVJA sought to revoke the air permit issued by the Ohio EPA for Harrison Power’s new $1B 630-megawatt natural gas power plant which it is constructing in Harrison County, Ohio. OVJA had tried to stop the plant by challenging the air permit, but the ERAC found that the group did not have standing because it failed to identify a single individual that was a member at the time it filed the appeal and thus failed to establish standing.
