Miller Quoted in Akron Beacon Journal Story Titled “Developer asks Federal Court to Reverse Tallmadge Decision Blocking 236 New Homes”
Joe Miller, a partner in the Vorys Columbus office, was quoted in an Akron Beacon Journal article regarding a decision by the Tallmadge City Council to block a plan to build new homes in Tallmadge. The property owner has filed suit in the Northern District of Ohio seeking to overturn the council's decision to block the construction of 236 new homes at a 124-acre site.
The story states:
"'The planning commission unanimously supported the development because it was entirely consistent with the zoning requirements and the surrounding area,' said Joseph Miller, one of the legal representatives for Mindale Farms. 'Yet, Tallmadge City Council followed the discriminatory intent of a vocal minority of not-in-my-backyard residents who opposed the development. City Council’s actions violated federal law and deprived Mindale Farms of its rights protected by the United States and Ohio Constitutions.'"
