Favorable Ruling for Critics of Section 230 of the CDA in Washington Case

Whitney Gibson, a partner in the Cincinnati office and the leader of the firm’s internet defamation and brand protection group, and Jordan Cohen, an associate in the Cincinnati office, co-authored an article for the Bloomberg/BNA Electronic Commerce & Law Report titled “Favorable Ruling for Critics of Section 230 of the CDA in Washington Case.” According to the article, Section 230 of the Communications Decency Act grants immunity to online service providers against liability arising from content created by third parties. In the article, Gibson and Cohen discuss two recent court decisions denying websites’ claims of such immunity and the potential impact these cases may have on future rulings.
