Securing State Seven – Indiana’s Legislature Passes Data Privacy Legislation

This past Friday, the Indiana legislature passed a comprehensive privacy law, adding to the growing collection of state privacy laws in effect or soon to become effective.  This bill is set to be sent to Governor Eric Holcomb for his approval and is projected to have smooth sailing as it received unanimous votes on both chamber floors.

Indiana’s proposed law looks very similar to the Virginia Consumer Data Protection Act – providing similar rights and exceptions – with a few key differences.  For example, Indiana’s legislation includes a generous thirty-day cure period that is not set to expire. Unlike most other states where privacy legislation is making significant headway, this law would not go into effect until January 1, 2026, giving Indiana businesses a significant amount of time for compliance.
