The Status of the 2024 Final Mental Health Parity Rule

Jacquie Abbott, of counsel in the Vorys Houston office and a member of the labor and employment group, authored an article for the American Bar Association’s Health eSource, titled “The Status of the 2024 Final Mental Health Parity Rule.”

The article provides a timeline of the Mental Health Parity and Addiction Equity Act (MHPAEA), which was published by the Department of Health and Human Services (HHS) during September 2024.  The ERISA Industry Committee filed a lawsuit against the Department of Labor, Treasury and the HHS during January 2025.  The departments requested to stay the litigation while it reviewed the MHPAEA final rule and paused enforcement with regard to the 2024 rule.  Jacquie noted, however, that this does not make MHPAEA compliance optional.
