Litigation Associate Obtains Dismissal in Pro Bono Case

Erika Mohr, an Associate in White and Williams’ Litigation Department, recently represented two tenants regarding eviction proceedings filed against them in a Northampton County Magisterial District Court. This matter was initiated by their landlord who sought recoupment of allegedly unpaid rent. In defense of this eviction proceeding, Erika not only raised breaches of the implied warranty of habitability but also filed a cross complaint seeking recoupment of any and all rent monies paid to the landlord during their tenancy.

Following argument from both sides, the Magisterial District Court Judge dismissed the landlord’s eviction proceedings and entered a judgment in favor of the tenants based on the identified breaches of the implied warranty of habitability. While the landlord sought to appeal this judgment in the Northampton County Court of Common Pleas, the parties ultimately came to a mutually beneficial resolution of the issues between the parties.
