Subrogation Department Settles Listeria Contamination Recall Matter

A major national distributor of high-quality, quick-frozen vegetable products incurred significant losses resulting from a listeria contamination recall affecting purchased vegetables. Recovery hurdles included potential issues regarding liability coverage and sufficient insurance proceeds. Notwithstanding these hurdles, Brian Tetro, a partner in the Subrogation Department and part of the firm’s Food and Beverage practice group, recently secured a near half-a-million dollar settlement for a new insurance industry client. The settlement represented nearly 70 percent of the client’s paid damages for the first-party claim.
