Subrogation Department Settles Water Damage Case for Seven Figures

William J. Schmidt (Bill), a partner in the Subrogation Department at White and Williams LLP, recently settled a water damage case for 73 percent of the claimed damages, resulting in a seven-figure settlement. The case involved the water sensors located in a cistern at a high-value condominium building, overflowing water, a failed back-up, high-level float and a floor drain that was not large enough for the volume of water overflowing from the cistern. Bill, with the assistance of Ryan Bennett, an associate in the Subrogation Department, placed multiple parties on notice, including the manufacturer of the sensor, the party that sold the water sensor, the company that designed the cistern control system and the building manager. The named defendants sued additional parties, resulting in a complex web of connections. At a settlement conference held shortly before the trial, Bill took a hardline position and successfully settled the case in a settlement that involved multiple parties.
