White and Williams Obtains Favorable Ruling for Insurer in New Jersey District Court
A U.S. District Judge granted Colony Insurance Co. permission to rescind a professional liability policy it had issued to Cherry Hill, New Jersey- and Philadelphia-based law firm Kwasnik Kanowitz & Associates PC on the basis that the responsible attorney made misrepresentations on the firm’s application for the policy. The application failed to disclose four past malpractice claims, litigation threats from a client, and a New Jersey Office of Attorney Ethics’ disciplinary complaint to the insurer. Judge Noel Hillman determined that these misrepresentations were critical in Colony’s risk assessment and led the insurer to issue a policy it might not have otherwise issued.
