23andMe Seeks Authority to Appoint Data ‘Representative’ In Bankruptcy Sale

This article discusses 23andMe’s recent motion seeking authority to appoint a “customer data representative” in connection with its effort to sell customer data as part of its pending bankruptcy case.
Since the publication of the article, the United States Trustee’s Office (a division of the Department of Justice) has opposed the motion and also asked the court for an order authorizing the United State Trustee to make the appointment of a consumer privacy ombudsman in connection with the sale. The Court will hold a hearing to consider the competing motions later this month.
