This is a discussion presented by Partners Gus Sara and Lian Skaf about recovery efforts against utilities and the multitude of issues that need to be considered. Among these issues include whether the utility is a government entity, whether any immunities apply, whether there are any statutory notice requirements and whether the utilities’ tariffs include exculpatory provisions or accelerated statute of limitations. This presentation will discuss these issues in more detail and address other potential challenges that can arise when pursing a utility.
