Insurance professionals frequently have to read and evaluate insurance policies. They often do so as part of their jobs assisting policyholders with claimed losses and as policyholders themselves. From the declaration pages to the last endorsements, insurance policies, like other contracts, require close and careful consideration.
Randy Maniloff will present a session: "Top 10 Duty to Defend Issues" on February 17th at 11:00 am CST which will cover the following:
- Understand the standards for determining whether a duty to defend is owed, why it is so broad, and whether the four corners of the complaint or extrinsic evidence is a factor in its determination
- Assess if independent counsel is owed to an insured for a defense under a reservation of rights, and what type of "conflict" in a reservation of rights can give rise to the insurer's need to hire independent counsel for the insured
- Enumerate what the new American Law Institute Restatement of Liability Insurance says about duty to defend issues, and whether insurers may take the new Restatement into consideration when addressing duty to defend issues
