John Eagan Weighs In on Supreme Court Internet Sales Tax Decision

On Thursday, June 21, the U.S. Supreme Court found in South Dakota v. Wayfair that a state may impose sales and use collection tax obligations on remote sellers that lack a physical presence in the state, overturning two decades of precedent that had prohibited such tax regimes.

Partner John Eagan spoke to Law360 about the significance of the decision, commenting that it "will have a significant economic impact to states where online sales were often transacted without the collection of sales tax as well as create compliance issues for internet sellers, who will now need to determine whether a sale is subject to sales tax in hundreds of state and local tax jurisdictions."
