Russell Klingaman to Present at the 2022 National Business Aviation Association Business Aviation Convention & Exhibition (NBAA-BACE)
Hinshaw's Russell Klingaman will present a session titled "Separate Business Entity Legal Issues: Recognizing and Avoiding FAA Regulatory Traps" on October 19, 2022. Business entities that exist solely to own and operate aircraft (i.e., LLCs or corporations) are generally considered commercial operators by the FAA. Commercial operators must possess FAA FAR Part 135 certificates if they have operational control when their aircraft are used as non-scheduled commercial transportation for any affiliated individuals and/or companies—"corporate flight department trap."
Klingaman will discuss:
- The FAA's increased focus on stopping "illegal charters"
- The legal problems associated with such operations
- How to avoid liability and other risks through contractual and operational solutions
The course is eligible for CAM application and recertification credit.
