Biography
His practice focuses on state and federal court litigation of commercial matters at both trial and appellate levels, as well as representing clients in arbitration and administrative proceedings. His experience includes participating in complex disputes related to corporate governance affairs, government bid and procurement, franchise and distribution law, product and premise liability claims, technology and privacy law, and general breach of contract and tort damages.
Prior to joining McConnell Valdés in 2021, he worked as law clerk to Hons. Jay A. García-Gregory and Juan M. Pérez-Giménez at the United States District Court for the District of Puerto Rico, and as an associate in the litigation department at another San Juan law firm. He was also clerk to Hon. Roberto J. Sánchez-Ramos at the Puerto Rico Court of Appeals. During this time, Mr. Álvarez-Valentín also participated in various conferences regarding information privacy, free speech, and media and technology law.
While in law school, Mr. Álvarez-Valentín served as a student law clerk to the Hon. Pedro A. Delgado-Hernández at the United States District Court for the District of Puerto Rico, was Editor-in-Chief of the University of Puerto Rico Law Review (Volume 87), and assisted Mortgage and Notary Law Professor Lourdes Quintana-Lloréns. He also published the law review article La tecnología en la Rama Judicial de Puerto Rico: Un mecanismo para fomentar el acceso a la justicia, 86 Rev. Jur. UPR 909 (2017).
Representative Cases
- Representing a major international surety company sued under various construction payment and performance bonds issued in favor of a contractor of a major government instrumentality, and in relation to a $150,000,000.00 plus turnkey contract.
- Representing an individual tech entrepreneur in an action filed against a lender for contractual fraud and illegal disposition of certain membership interests and a certain company asset under the Puerto Rico Uniform Commercial Code. The collateral is valued at more than $20,000,000.00.
- Representing a disaster recovery government contractor in several breach of contract and seven-digit collection claims against various municipalities and government agencies who allegedly mishandled and misprocured federal funds.
- Representing disaster recovery subcontractor in a breach of contract and collection of monies claim filed against the principal contractor of a government agency and the contractor’s CEO. Obtained partial six-digit summary judgment in favor of client and against the corporate entity.
- Representing a mainland manufacturer of energy products against its local distributor for breach of a distribution contract, collection of monies and seeking declaratory judgment in favor of client to determine that the contract was terminated with just cause under the Puerto Rico Dealer’s Act (Law 75).
- Representing a mainland paint manufacturer in a six-digit commercial warranty and product defect claim filed against it by a homeowner’s association.
- Providing advice and consultation to corporate clients regarding information privacy and data management policies in the context of web-based and mobile platforms.
- Representing a major insurance company against one of its shareholders who filed a corporate information petition under the Puerto Rico General Corporations Act. Obtained early favorable dismissal of action.
- Representing a majority shareholder, director, and officer of a Puerto Rico blockchain technology corporation in a derivative and personal lawsuit filed against other board members and officers alleging breach of contract, fiduciary duties, and information withholding, among others. Obtained settlement in favor of client reinstating him into the board and as official of the corporation.
- Representing a local steel corporation in Puerto Rico in a disgorgement of funds and breach of fiduciary duties claim against former officer who in turn sued the company for unjust termination. Obtained favorable settlement for client by which claims against the corporation were voluntarily dismissed.
- Representing a mainland steel manufacturer in a breach of contract, contractual interference and damages claim against its prior local dealer in Puerto Rico. Obtained favorable judgment in favor of client.
- Representing a health and beauty industry multinational in a product liability multidistrict asbestos claim filed against the client in Puerto Rico. Obtained early dismissal in favor of our client.
- Representing a major entertainment facility, a medical device company and a hotel in three premise liability claims filed against the companies for tort damages. Obtained early dismissal of action in the first case and favorable settlements in the second and third cases.
