On August 3, 2020, and in response to the passage of Tropical Storm Isaias on July 30, 2020, the Puerto Rico Department of the Treasury (“PR Treasury”) published Administrative Determination No. 20-20 (“AD 20-20”) of July 31, 2020, to:
- Extend until August 7, 2020 the due date to: (i) file all returns, informative returns and forms that were due on July 31, 2020 with the corresponding tax payments, and (ii) remit any payments or deposits of taxes withheld that were due on July 31, 2020;
- Impose no penalties for noncompliance with the bi-monthly sales and use tax (“SUT”) installments of July 2020, provided the total SUT due for said month is paid by August 20, 2020 with the SUT monthly return for July 2020;
- Waive any late-filing and late-payment penalties on any return, form, tax withholding, estimated income tax, excise tax and SUT payments that were due on July 31, 2020, if the taxpayer complies with the applicable tax filing or payment no later than by August 7, 2020;
- Extend the end date of the sales-tax-free holiday for uniforms and school supplies of August 2020 until 11:59 p.m. on Tuesday, August 4, 2020 (this tax-free holiday originally ran from midnight on July 29, 2020 until 11:59 p.m. on August 1, 2020).
If a penalty is imposed in connection with items Nos. 1, 2 and 3 above, the taxpayer must request its cancellation in SURI by providing evidence of payment and filing, together with a copy of AD 20-20, by August 7, 2020.
