Overview

All of the projects and funding under the IIJA will be distributed through grants, agreements and contracts issued directly by the federal government or indirectly through state, local or regional government entities that receive some or all of their funding from the federal government.

There are layers of laws, rules and regulations that apply to the processes for bidding, contracting and performing under these grants, agreements and contracts. Additionally, new rules are being developed specifically to address and implement the IIJA. We regularly advise and counsel clients on the development, implementation and compliance with such laws, rules and regulations.

We routinely assist clients in the drafting and administration of teaming and other strategic alliance agreements, contracts and subcontracts involved in bidding and performing these projects.

Specific procurements may be challenged pre-proposal submission or after award. We represent clients before administrative and judicial bodies at the federal, state or local level in such matters.

Additionally, we often work with clients to address claims, disputes, audits and investigations after agreements have been awarded. When issues arise, we counsel and represent clients before federal, state and other regulatory and investigative bodies. Our aim is to resolve issues at the lowest level possible.

Reach out to our Infrastructure Task Force for more information on how the IIJA may impact these industries.
