Micah helps clients navigate complex energy and environmental laws and regulations in a pragmatic and strategic manner.

Overview

With Micah's broad experience in energy, environmental, and natural resources law, clients rely on him to help them navigate the ever-changing landscape of clean energy development. From permitting and regulatory compliance to structuring corporate transactions, Micah leverages his experience to counsel clients, including developers, financers, independent power producers, utilities, and electric cooperatives, through the development and operation of renewable energy assets such as wind, solar, and storage facilities.

His transactional and regulatory practice includes advising clients on ongoing operations, acquisitions, and divestitures; land use and development guidance (including permitting, zoning, and environmental counseling); and project agreement review and negotiation (including power purchase, equipment supply, EPC, interconnection, and O&M agreements).

Micah also draws on diverse experience representing clients in administrative and court proceedings regarding environmental issues arising under state and federal laws. Micah brings a common sense, resolution-oriented approach as he advocates on behalf of his clients.

Experience

Micah regularly represents lenders and investors in connection with the financing of distributed solar and storage projects throughout the United States and has been responsible for counseling clients on interconnection, power purchase, operations, environmental, and permitting issues for transactions totaling over $175 million.

He also counsels clients regarding distributed generation interconnection and compliance issues in Minnesota and has represented multiple solar developers before the MN PUC regarding interconnection disputes.

In addition to Minnesota, Micah has advised clients on regulatory compliance for distributed solar generation and/or storage systems in CA, CT, DC, IA, IL, MA, ME, MD, NC, NJ, NY, OR, SC, VA, VT, and WA.

Micah represents utilities and large utility customers, including data centers and industrial and agricultural clients, in the negotiation of power and gas supply and related construction agreements, as well as associated permitting.

Micah regularly represents utilities and developers in the negotiation of equipment supply and construction agreements for wind and solar projects and has represented developers of utility scale wind and solar projects for purposes of project acquisition diligence, permitting and regulatory compliance, and defending administrative challenges to permits.

Micah has represented many clients on environmental issues related to recent and historic contamination, site access, and agency requests for information, and has particular experience in water use rights and contamination.

Micah has served as pro bono counsel for multiple conservation organizations, advising them on a wide array of land use and environmental law issues.

Micah has represented and counseled clients on various Renewable Energy Certificate (REC) purchase, sale, and compliance issues, as well as sustainability initiatives and compliance with related regulations and guidance.

Micah also recently represented the developer of a renewable natural gas (RNG) pipeline in securing route permit before the MN PUC.
