Overview
Jake is an associate in the environmental practice group based out of the Washington, D.C. and Cincinnati offices. He works with a variety of commercial and industrial clients across the United States on environmental issues including permitting and regulatory compliance, state, federal and administrative enforcement and litigation, and transactional due diligence. Jake uses his experience to take a practical approach to complex environmental issues and achieve the best outcome for clients based on their unique circumstances and needs.
Notable experience includes:
- Advising clients on various compliance issues under the Toxic Substances Control Act (TSCA), including Section 5 Orders, the Chemical Data Reporting Rule (CDR), import and export notifications, PFAS Reporting Rule, etc. and on Resource Conservation and Recovery Act (RCRA) compliance, including waste classification and exemption issues, permit compliance, inspection and information request responses and other waste management related issues;
- Leading clients in responses to state and federal enforcement actions, including negotiating settlements with regulatory agencies for administrative orders to resolve compliance violations;
- Conducting internal environmental and health and safety compliance audits at client facilities in various states to identify and implement improvements in compliance activities under all aspects of environmental law;
- Overseeing teams of environmental experts in several large-scale litigation matters in defense of complex contamination-related issues such as source identification, fate and transport, remediation, etc.; and
- Managing environmental due diligence in various real estate and corporate transactions, including managing Phase I and Phase II environmental assessments, drafting client-friendly contract provisions and overseeing the completion of post-closing environmental work. This includes working with state and federal agencies to transfer environmental permits and conduct necessary environmental background checks, such as through Ohio’s Environmental Background Investigation Unit (EBIU).
Jake received his J.D. from the University of Kentucky College of Law, where he was a senior staff editor for the Kentucky Law Journal and graduated as the class Valedictorian. He received his B.A. magna cum laude from the University of Kentucky.
