Miller Quoted in Columbus Dispatch Story Titled “Powell Ignoring Its Own Zoning Code, Federal Lawsuit Charges”
Joe Miller, a partner in the Columbus office, was quoted in a Columbus Dispatch story about a federal lawsuit that alleges that the city of Powell is ignoring its laws as they relate to a proposal for an extended-stay hotel.
The story states:
“Attorney Joseph R. Miller, on behalf of developers Golf Village North and Triangle Properties, alleges that the city’s development and zoning director, along with other city officials, has refused to rule on whether the facility is permitted under the city’s zoning code. Instead, the lawsuit says, the city has required developers ‘to expend thousands of dollars to create designs, plans and engineering in order to apply for a zoning certificate.’
‘I’ve never seen a city so clearly ignore the procedures of their own code,’ said Miller, who said he has 18 years of experience working with governments.
‘They’re simply shirking their duties,’ he said. ‘They’re ignoring their code to stop this development in its tracks.’
The lawsuit is filed in federal court, Miller said, because his clients’ ‘due process’ rights under the U.S. Constitution are being violated.”
