Miller Quoted in Columbus Business First Feature Story Titled ‘Fighting City Hall in Court’
Joe Miller, a partner in the Vorys Columbus office and the chair of the firm’s litigation group, was quoted in a Columbus Business First story about how developers have been forced to take municipalities to court in order to develop properties that they own.
The story states:
“Several instances of developers filing lawsuits and administrative appeals against municipalities over project denials have cropped up in recent months, pitting private interests against the public sector and stirring arguments about property rights, NIMBYism and overarching government control.
Legal experts say such cases are becoming more common.
‘I’ve been around for more than two decades and what I’m seeing is more and more resistance to development,’ said Joe Miller, a partner at Vorys in Columbus. ‘And you’re seeing it in communities all around Central Ohio.’”
The story goes on:
“Based on the continued growth of the region and pushback against certain developments in local communities, Miller said it is likely that more developers will sue municipalities that deny their projects.
‘You used to see this type of resistance here and there, but now you’re seeing it a lot,” Miller said. “Unfortunately, I think it’s going to continue.’”
The story also states:

‘These days, the NIMBYs are more organized and more outspoken,’ he said. ‘And there are too many local politicians who bend to their will rather than doing what’s right for the community.’”
