Ohio Supreme Court: Brief Summary of AWMS Water Solutions, LLC v. Mertz

Tom Fusonie and Greg Russell, partners in the Vorys Columbus office, authored an article for the Ohio Oil & Gas Association's journal, The Pipeline.  The article gave a brief summary of the decision for AWMS Water Solutions, LLC v. Mertz.

The article states: 

"On January 24, the Supreme Court of Ohio issued a unanimous decision in AWMS Water Solutions, LLC v. Mertz, 2024-Ohio-200, (i) affirming that an injection well operator has a protected property interest in its lease that can require compensation due to a governmental taking; and (ii) requiring the court of appeals to weigh the parties’ evidence to actually decide whether the state’s suspension of injection operations resulted in a total or partial taking of property.  OOGA participated as an amicus party in support of AWMS urging the Court to adopt this result."
