Chris Konzelmann serves as Co-Chair of the National Association of Subrogation Professionals (NASP) 2019 Subrogation Litigation: Skills & Management Conference.

Robert Caplan co-presented the panel Ethical Issues in Workers’ Compensation Subrogation Claims. Attorneys handling workers’ compensation subrogation matters face many ethical issues. From the initial investigation of a workers’ compensation claim, an attorney may need to advocate for the insurer, the insured, and the injured worker. As cases proceed, attorneys may enter into joint prosecution agreements with an injured worker and the insurer. When a lawsuit comes to a close, there is often the need to conduct settlement discussions at arms length while representing multiple interests. At all phases of the process, attorneys must understand the ethical implications of their actions, when and how to disclose conflicts to their clients, and how to avoid potential violation of their state’s rules of conduct. This session will focus on the ethical issues raised by the joint representation of carriers and injured workers, and best practices for alerting clients, resolving conflicts, and providing zealous representation
