Overview
Brad's bankruptcy litigation practice focuses on advising debtors, creditors and trustees of their rights and remedies. His cases span a variety of industries and business sizes.
An experienced trial attorney and an appointed Chapter 11 trustee, Brad litigates fraudulent transfer, preference, and other recovery disputes in hearings before U.S. bankruptcy courts and defends appeals to district and appellate courts. He also represents parties in commercial disputes outside of bankruptcy.
Prior to entering private practice, Brad was a Trial Attorney for the Department of Justice United States Trustee's Program, serving as counsel of record in over 650 bankruptcy cases representing the U.S. Trustee in cases involving health care, commercial real estate and internet technology matters. He also served as a Special Assistant United States Attorney where he assisted with white collar criminal prosecutions involving bankruptcy.
He is a fixture in the bankruptcy bar in the Eastern District of Virginia and District of Columbia, and has served on the local rules committees in both districts. Due to his knowledge of local practice, Brad is regularly sought out as local counsel for landlords, liquidating professionals and convertible note holders in nationally prominent bankruptcy cases.
Brad serves on the amicus committee of the National Association of Bankruptcy Trustees, advising and filing briefs in support of trustees on nationally important bankruptcy issues. He also maintains an active pro bono practice.
Experience
Represented the management company in a large hotel bankruptcy and served as lead counsel in a number of Chapter 11 cases involving small business government contractors.
Successful stabilization of a set of mixed-use properties in Washington, DC, which were sold at auction through a bankruptcy plan.
Served as lead counsel in business Chapter 7 cases, including a complex filing by a for-profit university facing class action litigation.
Represented bankruptcy trustee in a case resulting in the recovery and monetization of cryptocurrency.
