Drew develops and implements innovative solutions for creditors’ committees, secured creditors, equipment finance companies, and financial institutions aimed at protecting clients’ contractual and statutory rights in bankruptcy proceedings and civil litigation across the country.
Overview
Drew has served as counsel to creditors’ committees in multiple mass-tort bankruptcy proceedings across the country. As a zealous advocate for survivors, Drew has uncovered unreported estate assets, analyzed complex strategies to liquidate real property and other fixed assets, and negotiated complex plan provisions, such as third-party releases and survivor-trust protocols.
Among his recent successes as an advocate for creditors, Drew second-chaired a federal bench trial, obtaining a favorable decision that brought more than $50 million in assets into the bankruptcy estate. Drew has also assisted financial institutions with navigating disputes as part of complex agricultural liquidations in the United States Bankruptcy Court in Delaware; defended clients against preference claims; negotiated adequate protection stipulations and conditions of use of cash collateral; obtained relief from automatic stay; and recovered collateral through replevin actions.
Drew’s work is not limited to creditor representation. He has shepherded corporate clients in work outs with secured and unsecured creditors and through bankruptcies, receiverships, assignments for the benefit of creditors, and out of court wind-downs, liquidations, and restructurings.
Drew has also represented receivers, bankruptcy trustees, assignees, and similar fiduciaries in wind-downs, asset sales, claim objections, and adversary litigation. Recently, as lead counsel to a chapter 11 trustee, Drew obtained court approval of multiple asset sales, spearheaded litigation against the debtor’s equity owners, and drafted and obtained confirmation of a liquidating plan that ultimately brought an 80% return to unsecured creditors.
Drew has also developed a pro bono practice which focuses on advising residential tenants on their rights and remedies in eviction and other housing related litigation. Drew is the former chair of the firm's LGBTQ Employee Resource Group where he assisted the firm in recruiting and retaining LGBTQ attorneys and staff.
